SWEEPSTAKES PERIOD: The Tropicana TROPCN Sweepstakes (the “Sweepstakes”) begins at 10:00 A.M. Eastern Time (“ET”) on January 9, 2024 and ends at 11:59 P.M. ET on February 4, 2024 (the “Sweepstakes Period”).
ELIGIBILITY: The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia, who are 18 years of age or older as of date of entry. Employees of Tropicana Products, Inc. (“Sponsor”), Cramer-Krasselt, their respective parent, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies (collectively, “Released Parties”), their immediate and extended family members (including but not limited to spouses, domestic partners, parents, children, and siblings and their respective spouses, regardless of where they reside) and household members of each (whether related or not) are not eligible to participate or win. Void where prohibited by law. All applicable federal, state and local laws and regulations apply. Entry constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER: During the Sweepstakes Period, consumers can scan the limited edition Tropcn bottle with QR Code (“Tropcn Bottle”) or visit www.tropcn.com (“Website”) and follow the instructions to complete and submit the online entry form, to be entered into the Sweepstakes (“Entry”). Limit one (1) Entry per person during the Sweepstakes Period. The Tropcn Bottle can be found in the following locations at the following times:
Between January 9, 2024 through January 12, 2024, Tropcn Bottles will be distributed outside of the Las Vegas Convention Center.
Between January 15, 2024 through January 20, 2024, participating Kroger stores will have Tropcn Bottles available on shelf in the refrigerated juice aisle.
Any attempt by any entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's Entries and that entrant may be disqualified. Entries generated by script, macro or other automated means and Entries by any means which subvert the Entry process are void. Entries may not be acknowledged or returned. Any use of robotic, repetitive, automatic, programmed or similar Entry methods or agents (including, but not limited to, sweepstakes entry services to create fraudulent email addresses and/or identities) will void all Entries by that entrant. In the event of a dispute as to any Entry, the authorized account holder of the email address associated with the account used to enter will be deemed the entrant and must comply with these Official Rules. “Authorized email account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Potential winner(s) may be required to show proof of being the authorized account holder associated with the Entry.
RANDOM DRAWING/ODDS: On or about February 7, 2024, one (1) prize winner will be randomly selected from among all eligible Entries received for the Sweepstakes Period. Random drawing will be conducted by the independent judging agency (“Administrator”), whose decisions are final on all matters relating to the drawing. The odds of winning will depend on the total number of eligible Entries received during the Sweepstakes Period.
WINNER NOTIFICATION: The Potential prize winner will be required to complete a Declaration of Eligibility/Release of Liability/Publicity Release (“Declaration”), within 3 days of notification attempt or prize may be forfeited and an alternate winner may be selected. If the potential winner fails to return the completed Declaration within three (3) days, Declaration is returned as undeliverable, entrant shall be deemed to be ineligible, the prize will be forfeited and an alternate potential winner will be selected, time permitting. Declaration will be sent via email. Return of prize notification as undeliverable may result in disqualification and alternate selection, time permitting. If an entrant is disqualified for one of the reasons mentioned above and an alternate is selected, the alternate must complete and return the required documents in the timeframe specified. Potential winner is subject to verification by Sponsor/Administrator, whose decisions are final and BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. An entrant is not a winner of the prize unless and until entrant's eligibility has been verified and entrant has been notified that verification is complete. Administrator will make up to three (3) attempts to award prize after which, the prize shall remain unawarded.
PRIZE & APPROXIMATE RETAIL VALUE (“ARV”): One (1) Prize: A 4-day/3-night trip for the winner and travel companion to visit Key West, Florida. Trip includes round trip economy air transportation to/from the major airport nearest the winner’s home to major airport closest to Key West, FL, use of economy car rental for the length of the trip, hotel accommodations [double occupancy] for 3 nights, Mangrove Kayak Eco Tour for two (2), and a Day Trip with Snorkeling Excursion to Dry Tortugas National Park for two (2). ARV $6,795. All fees and expenses (such as security fees, gratuities, luggage fees, meals and ground transportation, and incidental charges) related to acceptance and uses of the prize not specifically stated herein are the sole responsibility of the winner. All prize activities are Sponsor-specified and winner may elect to use all or some of the experiences but winner will not be entitled to any compensation for any experiences they forfeit. In the event that the winner lives within one-hundred fifty (150) miles of Key West, FL, $250 will be provided in lieu of air transportation. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Seat selection and timing of trip subject to confirmation of reservations. Winner’s travel companion must be 18 years of age or older and must execute and return a liability/publicity release prior to travel. Winner and travel companion must possess valid travel documents (i.e., a valid government-issued photo ID, etc.) and travel on the same itinerary. Winner and travel companion are responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. No refund or compensation will be made in the event of the cancellation or delay of any flight except at the sole discretion of Sponsor. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. Lost, stolen or damaged airline tickets will not be replaced or exchanged. Sponsor shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any air carriers or other transportation companies or any other persons providing any of these services to passengers including any results thereof such as changes in services or accommodations necessitated by same. The passenger contracts in use by the airlines or other transportation companies shall constitute the sole contracts with respect to the Prize winner's and his/her/their travel companion’s transportation and such contracts shall be solely between the Prize winner, his/her/their travel companion and such transportation companies. Winner and travel companion must also pass any required medical testing and comply with any requirements, at any time, that may be required or recommended by any government agency, airline, hotel, any venue(s) included as part of the prize, or Sponsor, including without limitation, passing one or more COVID-19 tests, including, but not limited to antigen and screening tests, and testing negative for COVID-19 and/or having the COVID-19 vaccine(s) and booster. Winner and travel companion may also be required to execute any assumption of risk and/or other documents relating to COVID-19 or he/she may not be permitted to use the prize. In the event winner and/or his/her travel companion engages in behavior that (as determined by Sponsor in Sponsor’s sole discretion) is inappropriate or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person or endangers any person or property Sponsor reserves the right to eject them from any portion of the prize activities, in whole or in part, and send that winner and his/her travel companion home with no further compensation to winner. In the event Prize winner or travel companion engage in behavior during travel or participation in prize that (as determined by Sponsor in its sole discretion) is illegal, tortious, or subjects that Prize winner or travel companion to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by prize winner or travel companion as a result of such conduct. Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the sole responsibility of the winner. Winner will be issued a 1099 tax form for the actual retail value of prize awarded.
No transfer, assignment, substitution or cash equivalent for prize will be permitted, except Sponsor may substitute an alternate prize of greater or comparable value and Sponsor’s obligation to the winner will be fulfilled, and no other additional compensation will be provided. Resale of prize is prohibited. In no event will more than one (1) prize be awarded. Prize is awarded “as is” with no warranty or guarantee, either express or implied. All prize details are at Sponsor’s sole discretion.
GENERAL CONDITIONS, RELEASE AND LIMITATION OF LIABILITY: The Released Parties are not responsible for lost, late, incomplete, misdirected, invalid, stolen, inaccurate, garbled or unintelligible Entries, emails, or other communications of any kind, which will be disqualified. In exchange for the right to participate in the Sweepstakes, entrants/winner agree to release, discharge and hold harmless Released Parties from and against any and all liability (including, but not limited to, damages caused or claimed to be caused, losses, or injury or even death) arising out of participation and/or acceptance/use or misuse of any prize (including any inherent risk of travel), and agree to be bound by these Official Rules and Sponsor’s decisions, which are final. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Released Parties are not responsible for other errors or difficulties of any kind, whether human, mechanical, electronic, computer, network, typographical, printing or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, in the selection/announcement of the winner, the announcement of the prize, or in any Sweepstakes-related materials. NOTICE: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. The Released Parties are not responsible for faulty, incorrect, undeliverable or mis transcribed phone/email transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer, phone or device related to or resulting from participating in or experiencing any materials in connection with the Sweepstakes, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer, device transmission, or communications of any kind that may limit a user's ability to participate in the Sweepstakes. The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims. The Released Parties assume no responsibility for undeliverable emails, including but not limited to those resulting from any form of active or passive email filtering by a user's Internet service provider and/or email client or for insufficient space in user's email account to receive email. Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, misconduct or technical failures threaten the integrity of the Sweepstakes; or if a computer virus, bug, or other technical problem corrupts the administration or security of the Sweepstakes as determined by Sponsor, in their sole discretion. In the event of termination, the random drawing will be conducted from among all among all non-suspect, eligible Entries received prior to termination or prize will be awarded as otherwise deemed fair and appropriate by Sponsor. Any damage made to Website by an entrant will be the responsibility of the entrant and/or the authorized email account holder of the email address associated with the Entry. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.
Disputes: Except where prohibited, Sponsor reserves the right to make all decisions in its sole discretion arising out of or relating to the Sweepstakes, and the decisions by Sponsor are final and binding on all matters relating to the Sweepstakes. Except where prohibited, you agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with the Sweepstakes or the prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Florida; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participation in the Sweepstakes, but in no event attorneys’ fees; and (c) notwithstanding the foregoing, you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the United States of America and the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the laws of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.
PRIVACY: Any personal information that an entrant provides in connection with the Sweepstakes shall be used by Sponsor and Judging agency to administer this Sweepstakes, contact entrants, and for the other purposes set forth in the Sponsor’s privacy policy located at https://www.tropicanabrandsgroup.com/privacy-policy/. By entering this Sweepstakes, you agree to and accept that privacy policy.
