*FIELD OF THE INVENTION FIELD OF THE INVENTION This invention relates to a cigarette butt and ash receptacle for smokers having an inner removable container adapted to collect cigarette butts and ash deposited in the receptacle. The inner container may be of flexible foil material consisting in a preferred form of a flame retardant flexible material and may be reused or replaced after emptying, as required. The inner container may however be of rigid construction, reusable and cleanable as required. Reference herein to "cigarette" is intended to include "cigar".
28Jan98,A:\136 garin.cap,l -2- BACKGROUND OF THE INVENTION Many waste and cigarette disposal containers are known for use in public places but in the main these prior known containers do not have separate inner collection containers nor do they have means to extinguish the butts as they are deposited and contain the smoke and live ash normally arising from deposited butts which creates an environmental problem in public places.
Furthermore, emptying of these prior known containers can result in spillage of the deposited butts and ash and in windy conditions this can have a most undesirable effect.
SUMMARY OF THE INVENTION According to one form of the invention there is provided a cigarette butt and ash receptacle of elongated part-cylindrical form and adapted to be used in an upright manner whereby cigarette butts and ash may be deposited, and extinguished through apertures located adjacent the upper end in use of the receptacle, for collection in a removable container within the receptacle, said removable container being locked in use, against unauthorised removal from the receptacle.
PREFERRED ASPECTS OF THE INVENTION o: The part-cylindrical receptacle may be of hollow triangular cross-section across the longitudinal axis of the receptacle with one side of the triangular configuration having a plain surface constituting the back of the receptacle, said receptacle having apertures for receiving and extinguishing the butts and ash located along the upper parts of the other two sides adjacent the top of the receptacle.
According to another form of the receptacle, it may be of curved semi-circular or semi- 30 elliptical cross-section with the curved section facing outwards in use and with the apertures for receiving and extinguishing the butts and ash located in the curved face 27Ju198,A:\ 54garrin.cap,2 adjacent the top of the receptacle.
In both forms of the receptacle, it is desirable to have the top of the receptacle sloping outwards and downwards from the back surface of the receptacle.
The means for extinguishing the butts may comprise a mesh, perforated or non-apertured structure, preferably of metal, located within the upper part of the receptacle and suitably spaced from the outer sides thereof so as to allow insertion of a butt through an aperture and allow the lit or smouldering end of said butt to be pushed or rubbed against the said structure so as to extinguish same before being dropped into the removable container.
The apertures may be of triangular form, circular form or other suitable form as desired for the efficient operation of the receptacle by a releaseable locking means.
The removable container may comprise a rigid or semi-rigid locating member for receiving and locating an inner rigid container or flexible flame retardant bag, said locating member forming an inner back wall and part of the bottom of the receptacle for :I:r tremoval therethrough and said locating member being releasably lockable within the receptacle.
The locking means may comprise an abutment member on the outer part of the inner •back wall of the locating member engageable at a lower edge thereof by an angularly disposed spring leaf or like part secured to the inside of the back of the receptacle and adapted to be displaced by an elongated rod member inserted from the underside of the 25 receptacle through an aperture in the bottom thereof and adapted to engage over the abutment member after displacement of the spring leaf part so that pulling downwards of the rod member results in removal of the locating member together with the inner collecting container or bag member.
In order that the invention and its manner of performance may be more fully understood, reference will now be made to the accompanying drawings which illustrate 10Apr0 54garrin.cap.3 -4embodiments of the invention.

Notch on rod 28Jan98,A:\136 -6- DETAILED DESCRIPTION WITH RESPECT TO THE DRAWINGS Referring to Figures 1 to 11 of the drawings, the embodiment illustrated comprises a triangular shaped receptacle 5 having a back 6 and two front faces 7 and 8 with a top part 9 sloping downwards and outwards from back 6. Back 6 may be provided with apertures or other means for securement to a wall or other vertical surface.
The underside of the receptacle as shown in Figure 6 consists of a closure comprising a bottom lip part 10 of the receptacle back 6 and a base part 11 of an internal container locating member 12. A hole 13 in Figure 6 will be more fully described with reference to Figures 7, 9, 10 and 11.
o• :Referring to Figure 7, a back part 14 of locating member 12 extends upwardly adjacent and spaced from back 6 and is formed with lip parts 15 extending upwardly for a short distance in sliding relationship with front faces 7 and 8 of the receptacle. The back part 14 of the locating member is spaced from the inner side of the back 6 of the receptacle by the U-shaped lip 10 forming a sliding engagement with back part 14.
A container 17 being either of rigid construction or a flexible foil or other heat resistant or heat retardant bag is located within locating member 12 and open at its upper end.
A fixed inclined baffle directed part-way over and above the open end of container 17 may be attached to the inside of back part 14 of the locating member 12 but it has been found in practice that this baffle may not be essential to the operation of the invention.
The rigid construction of container 17 preferably has at least one side in sliding engagement with the other side or sides so as to allow complete access to the inner parts of the container for cleaning purposes.
The locking means for the receptacle 5 comprises an abutment part 23 (shown in broken line in Figure 13), secured to the outer face of back part 14 generally about two thirds up from the bottom of receptacle 5 but this is not a limiting location. Secured to the inner face of back 6 of the receptacle is a spring member 24 engageable in the 28.an9,A:\136 garrin.cap,6 locked condition of receptacle 5 with the underside of abutment part 23 as shown in Figures 7 and 9.
In order to unlock and remove the locating member 12 and its internal container 17, a rod member 25 is inserted through hole 13 and moved upwardly to engage on its chamfered end 26 the spring member 24 (Figure 9) and on further movement (Figure rod 25 has lifted spring member 24 off abutment part 23 allowing rod 25 to pass over abutment 23. Rod 25 is provided with a notch or elongated groove 27 of length and depth to allow rod 25 to engage over abutment 23 so that on pulling down rod which may have a handle part at its outer end, the locating member 12 and container 17 may be withdrawn from receptacle 5 for emptying the container or disposal thereof as may be necessary if the container is a bag.
Insertion of locating member 12 with its container 17 may be performed by pushing up the locating member until abutment part 23 overrides spring 24 which then sits in the locked position below and against abutment part 23.
Adjacent disposal apertures 19 spaced from the inside of the front faces 7 and 8 of the receptacle there is located a mesh, a perforated, or a non-apertured structure S: 20 preferably of metal, conforming to the configuration of faces 7 and 8 and secured, as by welding to the inner surface of top face 9. In the embodiment illustrated in Figures 14, 15 and 16 the mesh or perforated structure 20 which could also be a non-apertured "i structure, comprises two vertical side parts 18 of angular configuration having a projecting vertical planar part 21 extending from the apex of parts 18 towards the inner apex of front faces 7 and 8.
In use, a cigarette butt may be inserted through a disposal aperture 19 and pushed or S"rubbed against the structure 20 thereby to extinguish the butt and then allow it to drop down into container 17 in a non-smouldering condition. The space between the o 30 structure 20 and the receptacle front faces 7 and 8 is such as to allow engagement of a butt through disposal aperture 19 with the structure 20 and also allow the E" 30Wu198,A:\1 54garrin.cap,7 104 r 0~ -8extinguished butt to pass downwards into container 17.
Figures 12, 13, 14, 15, 16 and 18 relate to the embodiments of the receptacle 5 in relation to the shape of the disposal apertures wherein triangular apertures are substituted for the circular apertures of Figures 1, 2, 3, 7 and 17. Also the outer shape of the receptacle 5 may be altered to a semi-circular or semi-elliptical configuration as illustrated in Figures 17 and 18.
