Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement The purpose of the request is a screw cap composed of two parts, one upper and one lower, which due to its operation makes it difficult for children to open the container. The application contains a single claim that characterizes the invention because the upper part engages with the lower one so as to rotate the two clockwise and therefore to tighten the cap against the container and close it. However, the upper part turns crazy with respect to the lower part when an anti-clockwise rotation is applied, which prevents the container from opening. To open it, the counterclockwise rotation must be applied to the lower part, which is expected to be less than the upper height to make it difficult for children to handle. The search carried out in the sector of safety locks to avoid openings by children has not allowed discovering disclosures of the system of the invention prior to the application. Most of the disclosures correspond to the two basic systems cited by the applicant: opening by means of a combination of axial pressure and turning and opening by means of a combination of radial pressure and turning. There are also disclosures of closures that incorporate different types of bolts. The four documents cited, which are considered the closest to the application in the prior art, disclose caps composed of two elements that can rotate independently of each other. However, in these documents the lower part turns crazy with respect to the container. In this way, to release the lid of the container you have to hold the bottom and turn the top. In the invention the lower part is threaded to the container, it does not rotate madly with respect to it and to release the cap it is necessary to apply the rotation to said lower part, since the counterclockwise rotation applied to the upper part, still keeping the lower part fixed, would make the top turn crazy. It is, therefore, systems with some formal similarity but with substantive differences in structure and operation. Thus, taking into account the previous considerations and in the opinion of the examiner, the attributes of novelty and inventive activity should be recognized, in the sense of articles 6 and 8 of the current Law 11/1986, to the unique claim of the application.
