2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The object of the invention patent is, according to the content of claim 1, a disposable absorbent incontinence article comprising a radiopaque element detectable by scanner, thereby avoiding introducing the absorbent article into a washing machine and causing its failure. The absorbent article comprises an upper layer, an absorbent and a layer of impermeable material. Additionally, it also comprises an acquisition-diffusion layer (claim 2), and the radiopaque element is comprised in any of said layers (claim 3); this radiopaque element is formed either by fibers, particles, chips or in the form of a plate (claim 4); and is a metallic element (claim 5). Documents D01-D07 only reflect the state of the art. Document D01 shows a disposable absorbent incontinence article comprising an upper layer (105), an absorbent (103) disposed below said upper layer, a layer of impermeable material (117) disposed below the absorbent core and an acquisition layer -diffusion (107). It also includes intercalated between its layers a detectable element either visually or by means of a measuring instrument according to the nature of said element, which may be metallic, fluorescent or radioactive (description, paragraph 47); but the functionality of this element is none other than to detect levels of different compounds in the fluid (in urine or blood); and although we find in other documents of the state of the art, such as D02, a disposable absorbent element that could be used for incontinence, in this case compresses (description column 1, lines 14 to 16), which has radiopaque elements incorporated between its layers (description , column 2 line 64 - column 3, line 17), the function of these radiopaque elements is none other than to be detectable by scanner when the absorbent articles are used in surgical operations and not in order to be used as diapers, solving therefore a different technical problem to the one raised in the application. Therefore the solution to the problem posed in claim 1 of the present application is new and therefore also implies inventive activity. Document D03 discloses a disposable absorbent article for incontinence with the possibility of incorporating different elements, some of which are incorporated for viewing in low light situations, but in no case solve the technical problem posed in the application. Documents D04, D05, D06 and D07 show disposable absorbent articles for use in the field of surgery that incorporate radiopaque elements, which may be metals (document D04), but as the technical problem that solves these disclosures has been previously argued. It is different from the one stated in the present application, and therefore none of said documents shows an article like the one described in claims 1 to 5 and therefore cannot be considered as prior. On the other hand, it is not obvious that, from said documents, a person skilled in the art could conceive of a similar article with the characteristics mentioned in said claims. The invention claimed through the content of claims 1 to 5 seems to bring obvious improvements over what is already known in the field of disposable absorbent articles for incontinence and therefore can be considered to be new, involves inventive activity and has industrial application according with articles 6 and 8.1 of Law 11/86 of March 20 on Patents.
