ることはできなかつた。特に、多層構造集合住宅
が分譲住宅であるような場合、図示例のように、
4階の部屋の照明に使用される太陽光収集装置4
は4階の住人の所有であるにもかかわらず、5階
の住人の所有にかかる部分に配設されており、4
階の住人は自己の所有に係る太陽光収集装置に関
して所有意識が弱く、また、5階の住人は他人の
所有にかかる太陽光収集装置が本来自己の所有に
帰すべき場所に配設されているため、その取り扱
いに無関心であり、太陽光収集装置の取り扱いが
粗雑になり、太陽光照明が常に最良の状態で作動
しているものとは言えなかつた。また、上階の子
供が太陽光収集装置にいたずらして太陽光を遮ぎ
