使用する際の注意点
- ^ The wording “provision”, as “clause”, suggests an agreement between other agreements of a contract before a dispute arises, however such an agreement is possible as a separate contract after a dispute arises, and about legal relationships not arising from a contract between the parties. Nonetheless the “clause” wording is most common, even under the recast Brussels Regulation which employs the term agreement conferring jurisdiction. Some recent international legal acts, namely the Hague Choice of Court Convention and the Rotterdam Rules, opt for the term choice of court agreement.
- ^ “Venue” means a territorial jurisdiction specifically. However note that there use to be legal limits precluding agreements between the parties over subject-matter jurisdiction, e.g. in the United States they are deemed legally impossible altogether.
