These Terms and Conditions ("Terms") govern your use of the lvcoi.com website and the services provided by LVCOI ("Las Vegas Community Operating Intelligence," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.
You may use our website for lawful purposes only. You agree not to use the site in any way that could damage, disable, or impair our servers or interfere with any other party's use. You may not attempt to gain unauthorized access to any part of the site, its servers, or any connected systems.
All content on this website — including text, graphics, logos, the LVCOI brand mark, icons, images, and software — is the property of LVCOI and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent.
When you submit information through our contact form, you consent to us using that information to respond to your inquiry and follow up regarding our services. We will not add you to marketing lists without your explicit consent.
These Terms apply to all LVCOI services, including but not limited to AI Missed Call Text-Back, SEO and Local Search, Site Improvements, and Internal Tools. Specific service details, deliverables, and pricing will be outlined in a separate service agreement or invoice provided before work begins.
Service description: LVCOI provides an AI-powered system that automatically sends text messages to callers when a call is missed, engages in conversational follow-up, and collects lead information or books appointments on your behalf.
Pricing: The AI Missed Call Text-Back service requires a one-time setup fee (currently $497) and a recurring monthly fee (currently $297/month). Your first month of service is complimentary. Pricing is subject to change with 30 days' written notice.
Setup: LVCOI will configure and customize the AI agent for your business, including training it on your services, service area, and scheduling preferences. The one-time setup fee covers initial configuration, AI training, and integration with your phone system.
Your responsibilities: You are responsible for providing accurate business information for AI configuration, maintaining an active phone line compatible with the service, and responding to booked appointments and leads in a timely manner.
Qualified contractors receiving the AI Missed Call Text-Back service may be eligible for one free month of service after setup is complete. The free period starts on the date the service goes live for your business. After the free month, the standard monthly fee kicks in automatically unless you cancel per Section 8. LVCOI reserves the right to determine eligibility for the free month offer at its sole discretion.
Services are billed monthly unless otherwise agreed upon. Payment is due upon receipt of invoice. If payment is not received within 15 days of the due date, we reserve the right to suspend services until the account is current. We accept major credit cards and ACH transfers.
Either party may cancel ongoing services with 30 days' written notice. Upon cancellation, you are responsible for any fees accrued through the end of the current billing period. We will provide reasonable assistance in transitioning your data and accounts, including exporting contacts and removing our integrations from your systems.
Your data is yours. All customer data, lead information, contact lists, and business data generated through or uploaded to our platform remains your property. If you cancel services, we will provide your data in a standard export format upon request. We retain no claim to your customer relationships or business data.
Our AI text-back system is designed to engage in helpful, conversational follow-up with your callers. While the AI is trained on your business information and responds in a natural, human-like manner, it is an automated system. LVCOI is not liable for any misunderstandings, scheduling errors, or miscommunications that may occur during AI-generated conversations. You are responsible for confirming appointments and verifying customer details provided through the AI system.
To the maximum extent permitted by law, LVCOI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of our website or services. Our total liability for any claim arising from these Terms or our services shall not exceed the total fees paid by you to LVCOI in the 3 months preceding the claim.
You agree to indemnify and hold harmless LVCOI, its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.
Our website and services are provided "as is" and "as available." While we strive for excellence and stand behind our work, we make no warranties, express or implied, regarding the merchantability, fitness for a particular purpose, or non-infringement of our website or services. We do not guarantee specific results, rankings, revenue increases, or lead volumes.
These Terms are governed by and construed in accordance with the laws of the State of Nevada. Any disputes arising from these Terms or our services shall be resolved in the courts located in Clark County, Nevada.
We may update these Terms from time to time. The updated version will be indicated by the "Effective Date" at the top of this page. For active service clients, material changes will be communicated via email at least 30 days before taking effect. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
